Background and proceedings

Anthony Harper is acting for Settlers Albany Limited (a retirement village in Albany, Auckland), as plaintiff in a High Court claim, where Settlers has sued Auckland Council, CMP Construction Ltd (the head contractor) and MSC Consulting Group Ltd (the structural engineer) in relation to defective building work performed on 12 buildings at the retirement village. The defective work has led to significant defects and damage including weathertightness, passive fire and structural issues. The defendants have joined 34 third parties in the proceeding.
